MINUTES of the Parish Council Meeting  held from 7.30pm on Thursday
21 February 2008, at Gilchrist Thomas Village Hall, Littlewick Green.

2   08016 OPEN FORUM

Bisham Brook culvert works:
Mr A Ramsay HVA, noted that in Hurley High Street the position of the road closure seemed to change daily.  The signage had stated that Hurley High Street was 'Closed', but that this had been amended as this only applied to part of the road.

Mr Clarry,
of Shepherds Cottage Littlewick Green indicated that he was happy to answer any queries on his planning application; no questions were forthcoming.

3 08017  DECLARATION OF INTEREST

Cllr Burfitt declared a personal interest in planning application 08/00179 as his company owned land neighbouring
Deacon Lodge.

4 08018  PLANNING
An e-mail had been received from Mrs M Armson re overlooking at the Grasslands site. It was proposed by Cllr Jarvis and seconded by Cllr Sparrow then RESOLVED (8 in favour, 1 abstention), to send a copy of this letter to RBWM asking for their sympathetic consideration of Mrs Armsons reasonable request.

s  was proposed and AGREED (Unan) to discuss the application for Deacon Lodge earlier than listed on the agenda.  Cllr Burfitt had declared a personal interest.

08/00179 Deacon Lodge, High Street, Hurley, Maidenhead  SL6 5LT - detached triple garage with three dormer windows. Received 31.01.08.   Subject of a Site Visit.  This is an open fronted car port which will allow free flow of water and is thus considered by the applicant to be suitable for use in a Flood Plain. It is hidden by trees from the road and not readily visible by the neighbours.  It has a floor below the roof creating storage space. It was proposed by Cllr Mrs Baker and seconded by Cllr Mrs McLaren then RESOLVED (6 in favour, 1 against, 2 abstentions), to SUPPORT the application.
       
08/00165 Hall Place, Burchetts Green Road, Burchetts Green, Maidenhead  SL6 6QR - consent to display one non-illuminated freestanding double sided sign for Busy Bees Nurseries Ltd.  Received 26-01-08.  The Site was known to CouncillorsIt was proposed by Cllr  Westacott and seconded by Cllr Sparrow then RESOLVED (8 in favour, 1 against), to SUPPORT the application but noted that this seems to be a retrospective application as the sign is already in place.  It was also noted that the sign is in the Bisham Parish rather than Hurley. 

08/00153 Land at Top Farm and 1 and 2 Hall Place Farm Cottages, Honey Lane, Hurley, Maidenhead SL6 6RQ - (Amendment to Planning Permission 07/91131)  Received 26-01-08The Site was known to Councillors.  It was proposed by Cllr Burfitt and seconded by Cllr Mrs Baker then RESOLVED (Unan), to SUPPORT the application subject to the same condition as before, that the developer proposes a satisfactory landscaping scheme which integrates the plan into the area. Informative:  that any Section 106 money that becomes available should be dedicated to the Burchetts Green Village School and Hurley Play area fencing, given that the development will have impact on these local facilities. 

Ward Cllr Mrs Hunt suggested that the Parish Council should identify and put forward items for Section 106 funding where applicable.   The Clerk reported that RBWM Planning had offered to send an Officer to attend a Parish Meeting and discuss any s.106 items that Councillors might suggest.  The Section 106 Report lists projects required in Hurley Parish which should be consulted. 
File note: the proposed expenditure in the Section 106 Report agreed by the applicant is attached to the original planning permission in 2005 and is not updated.

08/00198 6 Goulders Cottages, Upper Culham Road, Wargrave, Reading  RG10 8NJ - change of use from agricultural land to residential (C3) incorporating a single storey rear/side extension.  Received 31.01.08.  Subject of a Site Visit.  It was proposed by Cllr  Jarvis and seconded by Cllr Mrs McLaren then RESOLVED (Unan), to SUPPORT the
Application as it is a very small triangular piece of land change to allow a square extension to be added to the back of the house.   

08/00190 The Warrener, Warren Row Road, Warren Row, Reading  RG10 8QS - erection of a horse walker (resubmission of 07/02348).  Received 31.01.08.  The Site was known to Councillors. It was noted there is still no planning application for the access and gate already erected onto Warren Row Road.  A letter attached to the planning application was read out stating that as the height of the fence round the horse walker has been reduced and it has no roof it will not harm the openness of the greenbelt.   It was proposed by Cllr Burfitt and seconded by Cllr Mrs McLaren then RESOLVED (8 in favour, 1 abstention), to SUPPORT the application subject to the removal of the temporary access to the road and the replanting to the hedge.  Informative:  that the Parish Council consider the position of the access to be inappropriate and dangerous.

08/00241 Hurley House High Street Hurley Maidenhead SL6 5NB
- consent to erect timber entrance gates to front, timber boundary fence to side and brick boundary wall to part of rear. Received 5-02-08. The subject of a site visit. It was proposed by Cllr Westacott and seconded by Cllr Harrington then RESOLVED (Unan), to SUPPORT the application, subject to the adjacent footpath width being maintained.

Listed Building Consent for the above:
08/00242 Hurley House, High Street, Hurley, Maidenhead SL6 5NB - consent to erect timber entrance gates to front timber boundary fence to side and brick boundary wall to part of rear. Received 5-02-08.  It was proposed by Cllr Westacott and seconded by Cllr Harrington then RESOLVED (Unan), to SUPPORT the application subject to the adjacent footpath width being maintained.

Change to Order of Items  was proposed and AGREED (Unan) to discuss the application, Shepherds Cottage early as the applicant was present. 
   
08/00277 Shepherds Cottage, Jubilee Road, Littlewick Green, Maidenhead SL6 3QU - two storey side extension and single storey rear extension.  Received 15-02-08. It was proposed by Cllr McLaren and seconded by Cllr Jarvis then RESOLVED (8 in favour, 1 against), to SUPPORT the application with an Informative that the windows on the side elevation should match the existing arched windows.       

08/00267 Willow Tree House,  Knowl Hill Common, Knowl Hill, Reading RG10 9YD -
Front entrance porch.   Received 6-02-08.  Subject of a Site Visit. It was proposed by Cllr Mrs McLaren and seconded by Cllr Burfitt then RESOLVED (Unan), to SUPPORT the application with an Informative noting that there are velux type windows on the roof at the front of the house; we are not sure if planning permission has been sought or is required.

08/00217 May Cottages, Lutmans Haven, Knowl Hill, Reading RG10 9YN -
Construction of a two bedroom detached bungalow with integral garage following demolition of two existing dwellings.  Received 31-01-08.  Cllr Jarvis commented that he would not want to see these cottages demolished as he believes that  they  have some historical/architectural merit.  It was proposed by Cllr Addiscott and seconded by Cllr Jarvis then RESOLVED (7 in favour, 2 abstentions), to OBJECT to the application as whilst the cottages are not listed they are of significant interest and permission should not be granted lightly for their demolition.  The Parish Council would request that consideration would be given to listing these cottages.  A counterproposal by Cllr Sparrow, who did not accept that the cottages merited  preservation, was not seconded and thus not voted on.

Certificates of Lawfulness:

Cllr Addiscott had, prior to the meeting, investigated the matter and e-mailed all councillors advising that that if a structure has been erected and remained unchallenged by planners for four years or was one for which planning permission was not required, the owner could apply for a Certificate of Lawfulness. Ward Cllr Mrs Hunt was asked to check with RBWM Legal and Planning on the problems perceived by the Parish Council in connection with Certificate of Lawfulness.

08/00199 The Old Boat House, High Street, Hurley
- whether the existing 2 metre high perimeter wall, fence and piers is lawful . Received 02-08  It was noted that in the Appeal Refusal, it was stated that the wall did not enhance the area and it is in the Flood Plain.   (Note:  the unsuccessful Appeal is noted below under "Decisions").  It was AGREED (Unan) that whilst we note the grounds for claiming a certificate of lawfulness, it takes no account of the conservation area and flood plain considerations.  The Parish Council is against this boundary wall and always have been.

08/00326 Knowl Hill House, Knowl Hill Common, Knowl Hill, Reading RG10 9YD
- to determine if a proposed outbuilding is lawful.  Received 13-02-08.   This is an amendment requested as the applicant already has an extant Certificate of Lawfulness issued in 2007.  Details were read out by Cllr Addiscott.  It was AGREED (Unan) that this appears to be yet another attempt to circumvent the planning process and should be resisted as strongly as possible  Were a planning application to be submitted for this development we believe it would be contrary to planning guidelines as an inappropriate development in the green belt. 

Tree Works

08/00193 The Coach House, High Street, Hurley, Maidenhead  SL6 5NB - notification to carry out works to two beech trees. Received 2-02-08.  There was a recommendation by the Tree Officer.  It was proposed by Cllr Addiscott and seconded by Cllr Sparrow then RESOLVED (Unan), to SUPPORT the application.

DECISIONS

07/03164 Temple Ferry Place, Mill Lane, Hurley, Maidenhead SL6 5ND. - construction of a 3-bedroom detached house following demolition of existing dwelling. Received  6-12-07.  HPC  Supported. 21-02-08 GRANTED Conditions 5, Informatives 1, Justifications 1.

07/03147 Dumbledore Warren Row Road Warren Row Reading RG10 8QS - single storey detached outbuilding.  Received 6-12-07. 20-12-07 HPC Supported with an  Informative that this needs an application for Listed Building Consent.  21-02-08 GRANTED DP3 EN4 GB1 2 DG1.

Listed Building Consent for the above:07/03146 Dumbledore Warren Row Road Warren Row Reading RG10 8QS - rear extensions and alterations.  Received 6-12-07. 20-12-07 HPC Supported.  21-02-08 GRANTED Conditions 4, tiles, bricks, windows to be agreed; Justifications 1, preserve the character of the listed buildings.

07/03145 - Dumbledore - Rear extension.  20-12-07 HPC Objected to the application as being contrary to GB2 and the openness of the green belt and that it will cause intensification of activity. 21-02-08 GRANTED Condition 1, Justification 1, DP3 EN4 GB1 2 4 H14 DG1 LB2.

07/03228 Long Reach, High Street, Hurley, Maidenhead SL6 5LT - Two storey front side and rear extension with rear Juliette balcony rear dormer window single storey side extension with pitched roof. 24-01-08 HPC Supported21-02-08 GRANTED Justification GB1 2 4 CA2 DG1 H14 P4 F1 T5.

Tree Works

07/03265 Little Orchard, Coronation Road, Littlewick Green, Maidenhead  SL6 3RA - to fell a Conifer. 24-01-08 HPC Unable to view the site, deferred to TO.  21-02-08 GRANTED.

APPEALS

T0355/C/07/2045195 The Old Boathouse, High Street, Hurley - appeal against Enforcement Notice issued for the erection of a detached double garage, boundary walls and piers. 21-06-07 HPC Objected by Written Representation.   REFUSED Appeals 3 Reasons 8.  The Clerk produced copies for the Councillors.

Other Planning matters


BCA amendments to planning application 07/01798 received from the RBWM for information only; accepted as a minor change.

RBWM Local Validation Consultation any comments by 25 March 2008.  Details found on www.rbwm.gov.uk/web/development_control.htm.  Letter read out by Cllr Addiscott. It was AGREED that the Parish Council had no comment.

RBWM Review of Conservation Area Appraisal comments by 17 March 2008.  Copies of Burchetts Green and Littlewick Green documents received.  It was AGREED that Cllrs Jarvis, Mrs McLaren, Westacott and Harrington to make comments on behalf of the HPC. 

RBWM Core Strategy DPD and working towards the Delivery and Development Principles DPD.  Comments by 12-03-08.  Details on . or telephone Julie Gil 01628 685745.  Cllr Addiscott read out the letter.  Cllr Sparrow suggested that the Hurley Parish Affordable Housing Survey should be of interest and the document should be copied to RBWM for their information and guidance. 

Section 106 from RBWM CSD - details on Pinnocks Wood Equestrian Centre Burchetts Green Lane.  The total amount was stated at £7,909.84 with £4,680 for public open spaces.
Ward Cllr Hunt suggested that the CSD could come and speak to the Council and advised that the  Section 106 contact would be Gail Kenyon.

RBWM Telecommunications Register - copy for reference detailing structures to which apparatus can be attached.  Cllr Jarvis suggested that the report be brought to the meeting when planning applications are received for masts.

Certificate of Lawfulness:  The Clerk had sent the letter drafted by  Cllr Sparrow outlining the problems perceived by the Parish Council, to Mr David Lunn, Chief Executive RBWM cc David Oram, Tim Slaney, the Borough Secretary and Rupert Avery, Legal Services Practice Manager. 

ITEMS ON PLANNING RAISED BY COUNCILLORS

Common Land Honey Lane. The Deeds have been received from Messrs C Joseph. The Clerk had sent a copy of the map to Cllr Addiscott tocalculate the area to meet RAP request. JA calculated the area to be 0.78 hectares which will now be advised to RAPThe Clerk had reported on the differences in tree insurances by email to the Councillors.

Dell Cottages
  Mr Keeley has been expressing continuing concern about the use of land adjacent to Dell Cottages but Cllr Addiscott has advised him that just because the Parish Council did not agree with RBWM's decision, this was not sufficient reason under the Ombudsman's terms of reference for him to intervene.
East Arms  An e-mail response received by the Clerk on (a) gates still in place and (b) the landscape maintenance obligations. As  the maintenance obligations are still not being met, Cllr Addiscott will contact RBWM Mr Carey.
Grasslands - see letter at 08018 above.

Grundons and Liaison Group Meeting.  The Clerk requested an extension for the Variation reply date until after this meeting.  Cllrs Harrington and Mrs Baker have drafted a letter.  It was considered that the run off from this site should be collected and subject to filtration before going into the public drain.  Ward Cllr Mrs Hunt explained that there was no filtration instead Grundons have a spillage kit.   Cllr Mrs McLaren suggested that it should be  mentioned in the letter that the Council had found the site meeting helpful.  Potential recipients of copies were discussed and listed by Cllr Mr Harrington.

White Waltham Airfield. Cllr Westacott reported on the meeting held the previous  week and distributed copies of complaints structure to Councillors.  Cllr Westacott explained that if anybody was annoyed by planes, they must report it and request a complaint reference number to ensure that the complaint is logged in the system; complainants should also take the name of the person the complaint was left with.  The telephone number to use is:  823272. 

TPO - Huntswood Farmhouse, Mill Lane, Hurley Village - a TPO for the Scots Pine tree was requested and  an e-mail response was received noting the request but saying that a TPO is not necessary at the moment.

Orchards Springs, Star Lane, now has a Mobile home in place:  The Clerk received an e-mail response from RBWM Planning stating that there was no breach of planning control.  The fact that it falls in the green belt is not relevant.

Land Adjoining Dodsley Copse Burchetts Green Road Maidenhead.  The Clerk e-mailed RBWM and received responses that the ditch has been reinstated which would prevent access and a hedgerow has to be replanted by March, if this does not happen, please contact them again.
Ye Olde Bell following a complaint regarding a 20 ft container parked in the grounds,  Cllr Addiscott read from e-mails from Planning explaining that, as it is ancillary to the business, planning permission is not required.

Conservation Area:  Cllr Jarvis suggested that Knowl Hill should have a conservation area.  This is to be put on the Agenda for the next meeting.

Boundary Elms:  Cllr Harrington was concerned about the large development at the junction where Green Lane meets Burchetts Green Lane.  Cllr Burfitt offered to check it.

08018  THE PROGRESS REPORT 

07165 Wooden Bench: 
Cllr Mrs Baker reported the wording on the bench would be Hurley Parish Council 2007 and is arranging for it to be installed.

07166 Salmon Leap Plaques at Hurley Lock
:  Cllr Burfitt would check to see if the plaque could be moved from one side of the concrete block to the other.

07166 Refurbishing the War Memorial at Know Hill:  Cllr Mrs Baker has a written quotation and is to make an application for funding as well as contacting Grundon for funding.

08005 Trees in Warren Row:  No update.

6   08019   MINUTES OF PREVIOUS COUNCIL MEETING 

It was proposed by Cllr Burfitt and seconded by Cllr Addiscott then RESOLVED (8 in favour, 1 abstention) that the Minutes of the December meeting were accepted as a correct record, subject to minor textural alterations The Clerk was also instructed that in future, with effect from the January 2008 Minutes, all of the Chairman's corrections should be included in the version of the Minutes circulated to Councillors for consideration and approval at the next meeting. The Clerk advised the Council that the minutes were the responsibility of the Clerk but the Council reconfirmed the instruction  that the Clerk should change the Minutes as marked up by the Chairman.

08020  MATTERS ARISING FROM THE MINUTES  NOT COVERED BY AGENDA ITEMS.

Flooding in Burchetts Green Lane:  Whilst it was reported that work had been done the Lane still floods;   after a downpour water flows over the Lane creating a severe traffic hazard and that this should be properly investigated by RBWM. Cllr Addiscott suggested a proper soakaway drain system should be put in.

08021  PARISH PLAY AREAS:
The Play Areas of Knowl Hill (including the trees) and Hurley were checked monthly by the Clerk.
   

Knowl Hill Affordable Housing site
:   there was some discussion of the Report received from Arlene Kersley.  Cllr Addiscott noted there are some items which require some adjustment.  Cllr Mrs Baker agreed to contact Ms Kersley to invite her to speak to the Council at the next Parish Meeting.

Insurance of trees: 
Details were e-mailed by the Clerk to Councillors before the meetingCllr Addiscott reported that one tree was leaning in the Knowl Hill play area and Cllr Burfitt agreed to contact the tree surgeon working on the Honey Lane verges to see if this could be felled.  The Clerk suggested there were also some trees cut by vandals which might require some work.  The poplars in the Hurley play area would also be checked by the tree surgeon. 

Hurley Fences and gates, there were details given at the last meeting that MDHA would pay 50% of the fences quotation; fences and gates to be ordered by the Clerk.

It was proposed by Cllr Sparrow, seconded by Cllr Burfitt then RESOLVED (Unan ) to AUTHORISE and APPROVE the Finance Statement.

08023  The Precept report was sent to RBWM and the tax base amount that was advised to be £975.28 has been adjusted to £969.70 with a band D of £18.15.

Audit  A new external auditor has been appointed by the Audit Commission for 2008, instead of UHY Hacker Young, which will now be Mazars LLP.  The cost will be less with Income/Expenditure over £25001.00 at £285.00.

Training course by the SLCC:  It was agreed to attend this course last year by the Clerk and Chairman/Councillor.  It was proposed by Cllr Addiscott seconded by Cllr Jarvis then AGREED (Unan) for the Clerk to book two places, for the price of £45 and £60.

08024 CORRESPONDENCE

10.1  NHS - Right Care, Right Place - public consultation.  Cllr Addiscott to review.

10.2  Mayors Charity Dinner Dance - 4 April 2008.

10.3  RBWM Public Rights of Way, Milestones Statement 2008/09. Copied to Cllr Hill. Reply by 21-2-08,
but can arrive late.

10.4 Postwatch consultation on closure of Post Offices, website details emailed to Councillors prior to the meeting.  Postwatch requested earliest reply, PO consultation closes 10-3-08.  The figures show that at Knowl Hill there are some 70 Clients a week which is less than the minimum required by the PO Ltd to keep the PO open.  Cllr Burfitt stated the PO should not be closed if it is over three miles to the next Post Office.  Cllr Jarvis stated this was a good three miles with limited access causing concern for those with reduced mobility and senior citizens.  The Highway Ave PO has long queues and this will become worse.   It was agreed a letter should be sent and Cllr Addiscott offered to provide a copy of the letter he has sent to the Clerk.

10.5 RBWM Legal Services Review of Policy and Guidance notes - street display of goods and 'A' Boards on the highway, dated 30-01-08.  Reply by 20-02-08, extension granted of one week, to 28-02-08.

11  08025  HIGHWAYS FOOTPATHS AND COMMON LAND

A copy of a Letter from Cllr Hill to the Forestry Commission expressing concern on how the work is being organised was noted.
