MINUTES of the Parish Council Meeting held from 7.30pm on Thursday , 1 November 2007, at Gilchrist Thomas Village Hall, Littlewick Green. PRESENT: Cllrs John Addiscott (Chairman), Mrs Sandra Baker, David Burfitt, David Jarvis, Steve Harrington, Geoff Hill, Harry Sparrow (Vice Chairman) and Chris Westacott. 1 APOLOGIES FOR ABSENCE Cllrs Mrs Kim McLaren and Tom Pratt were unable to attend the meeting.
2 07138 OPEN FORUM Burchetts Green Road - new access
Mr Friend commented that he believed that the owners of the land should be able to access it and they could not see why there has been such a problem.
Mr Higgins spoke for the three co-owners of the Verges and stated that the purchasers knew about the constraints on the use of the land when they bought it. The Application was to have unrestricted access but as it was started by trespassing it would anyway be more reasonable for it to be limited. There was also trespass to Forestry Commission land when damage was caused to about 1.5 acres of trees. In their favour the Applicants have now been open and have stated in Application that the ultimate proposal is for a small holding but there is no supporting paper work showing the details. There are concerns that this would include a farm house under a change of use for a small holding. Given that the Applicants main business included haulage and construction lorries, Mr Higgins suggested that the possibility of the land being used in connection with that business should be taken into account in considering this Application.
Mr Gutch noted there is no current access for general agricultural use and that the Applicants want a new gate for unencumbered access rather than through Mr Higgins common land; they want now to go from 8 to 10 days a year permitted by Mr Higgins, to 365 days a year access. he noted that there are many contradictions in the information included with the application sent to RBWM. He considered that the erection of the gate should have been subject to a Planning Application prior to its installation to allow proper consideration of objections. Cllr Mrs Wilson, one of the co-applicants, read out a statement stating that she and Mr Lillywhite bought this land from BCA three years ago. They restored the land to proper agricultural use and started a small holding. They have been in contact with the owners of the common land over which the current access passes and sought to be good neighbours and tried to find a amicable solution to the access problem. They have cleared ditches and worked to stop flooding which was when the alleged trespass and damage to Forestry Commission trees occurred. They had also contacted the owners of the verges in Honey Lane in an attempt to find an alternative access. The three owners of the verge in Burchetts Green Road sent a legal letter to stop anything other than access to arable crops. It was because of this denial of access that, on advice from their legal advisers a Planning Application was submitted. Reports supplied with the Planning Application included a Traffic Survey and appraisal of Sight Lines; from the South these are acceptable and from the North they are marginally short. Neither of the two vehicle accidents in the last month where drivers lost control by the first bend, were near the new access. She concluded by stating that the (Retrospective) Planning Application has been sought as every other way to gain access has failed. Two traffic experts have been consulted on general access for the purposes of agriculture and have prepared an independent survey. She request that this access should be permitted.
Mr Gutch commented that he did not agree with Cllr Mrs Wilson's earlier statement.
Mr Higgins Commented that the Applicants were aware of the use of access to the land when they bought it and that pressure should not now be put on local residents for this to be changed. The guidelines from BMR (?) are that there has to be 120m safe view in each direction and this can only be achieved by viewing over hedges and trees which would need to be kept trimmed for sight lines to be maintained. If the new access was to be permitted it would need to be subject to an agreement in perpetuity to keep these trees cut back; how would this ever be enforced?
Mr Gutch Requested this application to be called in and go to the Panel. Cllr Mrs Wilson replied as the Application is from a Councillor, that this automatically goes to the Panel.
Cllr Burfitt declared a personal interest as his company owns land on the other side of the road to the new access subject of this Planning Application. Cllr Burfitt wished to raise two points , (i) that 40 years ago his family rented the 30 acres and there were no restrictions on the normal agricultural use and they used the existing access many times more than 8 or 10 times a year; in the region of perhaps over 350 a year. (ii) that the new access had been reported to be created because of vandalism and invited Cllr Mrs Wilson to comment.
Mr Higgins commented that he had been 25 years in the village. During the last 20 years the land in question had been used for crops. Owners of the common land verge want to keep a degree of control over the use of the access and thus the land to continue as the custom and usage over 20 years.
Cllr Mrs Wilson stated that Vandalism was one of the main reasons for the access as they require access not only for crops, but also for access for equipment to build and access a barn, otherwise they cant protect their goods. The gate was installed as an emergency.
Mr Lillywhite (the co-Applicant) advised that the problem is not vandalism, it is theft and they have lost thousands of pounds worth of property. On one day, they cut hay and in the morning, the tractor was stolen. The gate was rammed off its hinges; a truck was needed to do this, it was not casual, but had to be planned. They need the access to move agricultural equipment. They have ploughed, reseeded and wanted to use the land for cattle. Cllr Burfitt commented that he had no problems moving farm machinery through the lanes using the existing access. A resident who used to live in Drift Road said that there permission for a shed was requested because a machine was stolen;, this lead to other requests and now Drift Road is shed road.
Ms Creer offered to make a legal point on proscriptive easement which the Council expressed interest in. To establish an easement by proscription demands 20 years uninterrupted prior use. If the proscribed right of way has been the purpose for arable crops then only this is allowed. A horse or car cannot be used, the proscribed right is vested in the user. If the access has not been used for general agricultural use in the 20 year period, then that use is lost. The critical dates are the date for trying to establish the right, which is from now, back over 20 years.
Mr Higgins pointed out that permission for a small holding would imply the right for a house to be put on the land. Cllr Addiscott pointed out the application is for the access only and must be considered as such; any future application for asmall holding or a house would be considered at the time.
Mr Gutch reiterated that before the land was sold the access restrictions were fully explained to the Applicants..
Honey Lane entrance from Burchetts Green Road
Mr Brian Stanton reported that a notice had been erected for the Honey Lane entrance from Burchetts Green on the right but the notice is too high to see as you come up the incline of the road. Could it be put a little lower. Cllr Addiscott said this had been put up by the District Council.
Henley Road
Cllr Mrs Hunt reported that the three District Councillors were very concerned about the traffic refuge island on Henley Road and are pressing for it to be taken away.
Bisham Brook Culvert , Hurley High Street
Cllr Burfitt raised a query regarding these works which were scheduled to be done in October but now seemed to have been delayed until the new year. He had been advised that the road would not be closed but was concerned large machinery/lorries would be unable to pass.
Cllr Mrs Hunt offered to recheck the date of works.
Knowl Hill grassed play area
Mr Lillywhite stated he had a list of residents objecting to the idea of building two affordable houses on the land and requesting it to be left as a play area.

4 07140 CURRENT APPLICATIONS: Site visits are carried out prior to the meeting where appropriate. 07/02635 Listed Building Consent Dewdrop Inn Honey Lane Hurley Maidenhead SL6 6RB - removal of internal wall.
It was noted this is the wall between the bar and the servery. It was proposed by Cllr Burfitt and seconded by Cllr Sparrow then RESOLVED (Unan), to SUPPORT the Application. 07/02712 Land Adjoining Dodsley Copse Burchetts Green Road Maidenhead - formation of vehicular access (Retrospective). It was suggested that there are two particular queries on this application, (a) is there a need and (b) is it safe. The applicants have not been denied access to the land for some limited purposes. In relation to the Sight Lines in the Planning Application it was considered a dangerous egress out of the site. When looking north it is possible to see through the trees and hedge. To the South it would mean looking through one tree and to achieve a clear sight line would require removing the hedge, therefore, it was considered that it is not a safe access. The undergrowth reduced to 2ft would mean you can see along the road. When seated on a tractor, it is possible to see over the hedge. Cllr Sparrow noted the need for the access for agriculture other than arable. There are things that can be done to make access safer which could be left to the RBWM Highways. The owners have a right to use the land and are entitled to a new access. Cllr Jarvis commented that the application looks at that only. Access is for arable use. The access now is an adequate access. In the application the intention is for a small holding . Cllr Burfitt mentioned tractor acceleration and commented that a tractor, possibly pulling a trailer, would take sometime to clear the access and make space for a car to pass; there must therefore be adequate distance for an oncoming vehicle to brake. From the map there does not seem to be adequate distance. Whilst the sight lines shown on the drawing indicate adequacy, it doesn't prove that it is safe in this case when looking at the site. Mr Brewster of RBWM has admitted in correspondence that this is a "substandard access". RBWM have confirmed that the adopted Highways goes to the roadside edge to the ditch, everything else to the hedge is deemed to in the neighbouring ownership. It is unclear whether or not the Applivants have sought and gained RBWM approval to access over their land. An Email from Mr C Joseph was read out strongly objecting to the access mentioning cars speeds are 60mph. An email from Mr Higgins had been received objecting to the access. Cllr Addiscott advised that RBWM had previously confirmed that there was no plan to change the speed limit on BG Road. Cllr Sparrow proposed to Support the application, leaving safety to RBWM. His proposal was not seconded It was then proposed by Cllr Jarvis seconded by Cllr Harrington and RESOLVED (6 in favour, 2 against), to OPPOSE the application as the need for the access was not proved and it was considered not to be a safe access, with the Informative that the two portacabins and concrete hard standing present, which are engineering works, require a planning application. LATE POST 07/02802 0 East Arms Place Hurley Maidenhead SL6 5LE - erection of entrance gates and walls from High Street. Gates 1.2m, walls 1m and piers at 1.5m high. It was noted that this is a very contentious issue and concern was expressed that residents would not be able to comment if the application was considered at this meeting. The RBWM Planning to be contacted to request extending the consultation date. Cllr Mrs Hunt was request to see that this goes to panel. TREE WORKS 07/02661 Ye Olde Bell Hotel High Street Hurley Maidenhead SL6 5LX - notification to reduce by 2-3m on 3 Sycamores. Tip reduce the side profile of row of Conifers by 2m. Reviewed by Cllr Burfitt. The 3 sycamores are killing everything and are over the fence and the conifer is over high. It was proposed by Cllr Burfitt and seconded by Cllr Jarvis then RESOLVED (Unan), to SUPPORT the Application. 07/02752 5 Wickhurst Cottage Bath Road Littlewick Green Maidenhead SL6 3RQ - to fell one Tree of Heaven. Reduce the height by 2-3ft of one Conifer, crown reduce by 20% and crown thin by 10% one Apple Tree. Coppice one Hazel to seven foot trunks. Reviewed by Cllr Jarvis. The Tree of Heaven is near to the wall of the house, is not sightly and others to be reduced next to it. It was proposed by Cllr Jarvis and seconded by Cllr Westacott then RESOLVED (Unan), to SUPPORT the Application.

ITEMS ON PLANNING Raised by councillors Request by Cllr Mrs McLaren for support- Application on: 07/02292 The Old Cottage Coronation Road Littlewick Green Maidenhead SL6 3RA - single storey side extension. HPC Supported. Cllr Mrs Hunt has asked for the Application to go to the Panel. Cllr Burfitt stated that the Parish Council had perhaps three times in ten years attended to support a Planning application. It was proposed by Cllr Addiscott and seconded by Cllr Burfitt then RESOLVED (Unan), as a principle, not to attend. Common Land Honey Lane. Certificates have been received from Messrs C Joseph and completed by the Chairman and Clerk, the Invoice to be found in Finance. The insurance of trees and verges to be arranged by the Clerk to cover this transferred part of Honey Lane. Cllr Burfitt thanked Cllr Hill on behalf of the Council for the gift of these verges to the Parish Council Dell Cottages - Cllr Addiscott contacted RBWM, Mr Stallwood and commented that it was not accepted that there is a business run at this property and requested confirmation that, if owners apply for prescribed business use, this will not be agreed as the Parish Council has been objecting over many years. East Arms - Copy of Management Plan received, to be reviewed by Cllr Addiscott. Grundons - Cllr Baker reported the Liaison Group Meeting Agenda had been sent out for the meeting at 5.30 pm on 20 November 2007. Cllr Mrs Hunt had been in contact with Grundons about old buildings which are not satisfactory. The Old Boathouse, Appeal Decision - was requested to be checked. White Waltham Airfield - Cllr Westacott reviewed the last meeting, 30.10.07. Mrs Grey of Chalkpit House complained about the aircraft noise as on Saturday and Sundays she cannot use her garden. The Airfield is keeping to the circuit which protects the local villages but rural houses suffer. It was noted that three lines of flight circuits converge on the nearby roundabout where there were 20 flights in one day. Cllr Westacott and other residents are having a meeting to discuss this. If they vary the circuits this would be better. The Airfield are happy that they are receiving fewer complaints but the weather has been bad with fewer flights. Littlewick Green Village and Burchetts Green Village have complained but a reference number must be requested when complaining to have it logged correctly. Cllr Mrs Hunt reported on the development of the Hanger and its permitted development rights. Grasslands - It was reported that it has been suggested that trees were to be pulled down to open vistas for selling purposes. It was stated that when the landscape plan was approved, more trees would be planted. If the undergrowth is cleared, there would be views of the river. It was AGREED that this situation should be monitored. Honey Lane - It was reported that the original Honey Lane (adjacent to Broad Oak House) is already being used as a rat run. It has been suggested by residents that bollards or a key coded barrier should be installed, as it was considered that signage would not work. A padlocked gate may be installed but this may be a problem for other users. The HPC is concerned with this on going problem and suggest a Traffic Survey may help to give accurate usage. It was AGREED a letter to RBWM suggesting asking for some help in this matter and supporting the request to install a road traffic counter. Cllr Burfitt stated he still brings cattle down old Honey Lane for transfer to the field across Henley Road as he cannot easily control them at the end of the new stretch of road where there is a large open area into which the cattle can stray. It was also noted that the old road is still needed as large vehicles cannot turn and return to the Henley Road back down the old lane." It was noted that, in the middle of old Honey Lane, a close boarded fence has been erected. There will be no gravel trap, although this would be a safety feature for cars using the new road. It had been established that the gravel trap was a non-binding recommendation by the Inspector following the public enquiry some years ago. RBWM Maidenhead Development Control Panel meeting Next meeting on 14 November 2007 in the Council Chamber, Town Hall Maidenhead. At the Development Meeting on 17 October, held at St Josephs Centre 36 Cookham Road Maidenhead the application 06/02897 Pinnocks Wood Equestrian Centre was discussed: details emailed to Councillors.
5 07141 PROGRESS REPORT
HPC IT - the new Hotmail yearly subscription - £14.99 - caused problems as the database would not accept a new credit card and details and closed hotmail down. Cllr Jarvis suggested some kind of float of about £100.00 for the Clerk to use when expenses paid became a problem. The Clerk stated that a Petty Cash system would cause problems and payment by receipt as used is sensible. However, expenses do become a problem from time to time when paying a credit card off to prevent interest fees. The bills and a £63 print cartridge adds up making it difficult, for example, to afford an extra print cartridge as a spare on a credit card, with a due payment date not consistent with the HPC monthly meeting. Cllr Burfitt suggested if it was a problem the Clerk should arrange a cheque to be signed as an interim payment.
6 07142 MINUTES OF PREVIOUS COUNCIL MEETING
Cllr Addiscott stated that the Clerk had not edited the Minutes as he had marked up and that if this happened again he would bring all marked up changes to the meeting to bring them to the notice of the Council. The Clerk said that as she was responsible for the accuracy of the Minutes she had taken note of Cllr Addiscotts comments in her revision of the expression of the Minutes. That the Minutes had been rewritten by Cllr Addiscott and that the Clerk Objected as she had not ignored them. Cllr Addiscott demonstrated that his corrections had not been incorporated by reference to "the recent meeting with Grasslands" in minute 07127 (p.4) which should have referred to "the recent meeting with the relevant RBWM officer (Graham Brewster)" Cllr Westacott stated there had been arguments over the minutes at every meeting since he became a Councillor in April 2007. Cllr Baker stated that the Clerk should change the Minutes as marked up by the Chairman. It was proposed by Cllr Westacott and seconded by Cllr Burfitt then RESOLVED (7 in favour, 1 abstention), that the Clerk alter the Minutes at the direction of the Chairman. Cllr Burfitt suggested that the Clerk bring any problems on changes to the notice of the Council. The August Minutes had some notes on items at the beginning of Open Forum which could now be added. It was proposed by Cllr Jarvis and seconded by Cllr Harrington then RESOLVED (7 in favour, 1 abstention), that the minutes of the meetings held on 23 August and 13 September 2007 were accepted as a correct record, subject to a number of minor textural alterations. It was proposed by Cllr Jarvis and seconded by Cllr Harrington then RESOLVED (7 in favour, 1 abstention), that the minutes of the meeting held on 4 October 2007 were accepted as a correct record, subject to a number of minor alterations discussed at this meeting. 7 07143 MATTERS ARISING FROM THE MINUTES not covered by Agenda items. Cones in Hurley - Cllr Addiscott will be arranging a meeting with Steven Brown, RBWM on use of the cones to control parking in Hurley High Street. Common Land verges - Boundary markers Cllr Harrington will arrange markers between HVA and BGV land. It was proposed by Cllr Addiscott and seconded by Cllr Jarvis then RESOLVED (Unan), to authorise payment for the markers to a maximum of £75.
Honey Lane verges: Cllr Hill reported he had met with Mr Joseph and signed the documents transferring the land to HPC. Wooden Bench - Cllr Baker had arranged for the metal stays to be given to the fitter. Cllr Burfitt would be having the bench installed and contact the PPI. The Chairman requested that the Item 8 Chairmans Report be suspended from the Agenda unless requested. 9 07144 PARISH PLAY AREAS: Knowl Hill and Hurley
The Play Areas of Knowl Hill (including the trees) and Hurley were checked monthly by the Clerk. 9.1 Affordable housing: the Parish Councils policy has been to continue to work towards arranging housing to be built on this area if possible due to continued vandalism of the play area and equipment. The Housing Needs Survey is underway. Mrs Kersley reported that the letters would be delivered to Cllr Baker at the end of this week. She had advised that it would not be advisable to apply to RBWM under the Local Development Framework, instead any application for this should be as a Rural Exception site. Once the Housing Needs Survey is completed by Residents giving their views (re item in Open Forum), the Choseley Road site can be put forward as a Rural Exception site 9.2 Fence at Hurley Play Area: The Clerk provided an aerial photograph of the site sent by MDHA. Councillors Addiscott and Sparrow had inspected the fence from No 52 to the main road noting the 85m stretch. It was suggested to leave the fence to the Henley Road but to get a quote for the gates on that side. The Clerk is to arrange a site meeting with MDHA, Cllrs Sparrow and Addiscott. The Clerk reminded the Council that Cllr Sparrow had suggested this be budgeted for next year and that then there would be new funds from Section 106. Cllr Burfitt noted this and Cllr Sparrow said the fence could not wait until next year. 9.3 Grass Cutting: Mr Jason Dean had been cutting the grass and generally caretaking the Hurley play area since Tim Turvill gave it up and, subject to the Council's approval, Cllr Addiscott will arrange for Mr Dean to prepare invoices back to May 2006 for £30 a month. The HVA had suggested (probably tongue in cheek) that HPC buy their grass cutting machine to use on the grass - it is also used by HVA to cut the grass to the football pitcjh. Cllr Burfitt asked if the auditor would agree with this arrangement. Cllr Addiscott stated that, in his opinion, the Council could make whatever arrangements it thought appropriate. It was proposed by Cllr Addiscott and seconded by Cllr Sparrow then RESOLVED (Unan), to authorise the payment. 9.4 Moles It was reported they are in the Play Area and a mole catcher should be contacted to look at this problem. It was proposed by Cllr Addiscott and seconded by Cllr Jarvis then RESOLVED (Unan), to authorise the expenditure. 9.5 Knowl Hill Play Equipment: Cllr Jarvis reported that this was so popular that it was becoming a nuisance to neighbours. A request for transport to Maidenhead for the children at Knowl Hill has been received from Residents to give them another venue to play.
10 07145 FINANCE REPORT It was proposed by Cllr Burfitt, seconded by Cllr Mrs Baker then RESOLVED (Unan) to AUTHORISE and APPROVE the Finance Statement. The monthly report can be viewed at meetings and be available for inspection on request.
07146 Budget for 2007/08 draft: Cllr Sparrow had checked the draft budget provided by the Clerk to Councillors and suggested he would contact the Clerk to amend the details so that the draft could be presented at the next meeting.
Internal Auditors Report, copies provided by the Clerk. Cllr Jarvis noted that it was stated letters should be sent by the Clerk. Cllr Addiscott responded that he wrote as the Chairman. The Clerk stated that letters on behalf of the Council should be sent by the Clerk, that the Chairman can send letters as a member of the council as Chairman.

12 07148 HIGHWAYS FOOTPATHS AND COMMON LAND 12.1 Signage Village Sign to be proforma ordered by the Clerk for Cockpole Green - in hand. 12.2 Honey Lane Road Sign (re item in Open Forum) it was agreed to send a letter to RBWM that it has been brought the attention of the Council that the new sign should be lowered.
12.3 Parking on Shepherds Close: it was reported that letters are to go out. 12.4 Parking by the Play Area at Knowl Hill: The Clerk reported speaking to the new PCSO who is contacting PC De Haan on the problem and checking the area. 12.5 Insurance of Trees in the Parish: Cllr Hill noted the comments produced by the Clerk from the SE Regional Conference of the Tree Wardens were to be commended, copied to the Councillors, included a suggested every 5 years professional inspection.
13 07149 URGENT ITEMS FOR DECISION/COUNCILLORS ITEMS OF INTEREST
Untaxed Vehicles: Cllr Mrs Baker brought a problem to the notice of the meeting reported by Cllr Pratt who was unable to attend, on the parking of untaxed vehicles on common land at Knowl Hill. It was agreed to defer this to the next meeting.
